By accessing or using Symptly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Symptly is a personal food and allergy reaction tracking application that allows you to:

  • Log meals and ingredients you consume
  • Record allergic reactions and symptoms
  • View correlations between foods and reactions
  • Save meal templates for quick logging

3. Medical Disclaimer

IMPORTANT: Symptly is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or health condition.

  • The correlations and insights provided are for informational purposes only
  • Do not rely solely on Symptly for medical decisions
  • Always consult a qualified healthcare professional for medical advice
  • In case of a severe allergic reaction, seek emergency medical attention immediately
  • Symptly is a personal tracking tool, not a substitute for professional allergy testing

4. Account Registration

To use Symptly, you must:

  • Be at least 16 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

5. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes
  • Provide accurate information when logging meals and reactions
  • Not attempt to access other users' data
  • Not interfere with or disrupt the Service
  • Not use the Service to collect information about other users
  • Not use automated systems to access the Service without permission

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Symptly and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the data you input into the Service (meals, reactions, etc.). By using the Service, you grant us a limited license to store and process this data solely to provide the Service to you.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including sensitive health data.

You acknowledge that you are voluntarily providing health-related information and consent to its processing as described in our Privacy Policy.

8. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Emergency repairs
  • Technical issues beyond our control
  • Force majeure events

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.

10. Termination

You may terminate your account at any time through the Settings page. Upon termination, your data will be permanently deleted as described in our Privacy Policy.

We may terminate or suspend your account immediately, without prior notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

12. Indemnification

You agree to indemnify and hold harmless Symptly and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Symptly operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
